Trademark Partners - protection and brand management in Asia

Best practice:
The exclusive right to a trademark belongs to the first to register it. Our advice: be the first, #File1st®.
In many countries, such as China, the ‘first-to-file’ rule applies, meaning that the first application or the one with the highest priority takes precedence in trademark protection. The ‘first-to-use’ rule, where earlier use of a trademark is important, is less common and is applied in countries like India.

Registration process
step-by-step*

01
Preparation and filing of the application
The scope of protection for the trademark is specified, products/services are designated, documents and use evidence (if permitted) are prepared. The stage ends with the filing of the application with the Office by the local patent attorney.
02
Application examination
The Office examines whether the trademark is eligible for protection under the law and in the context of previously filled other applications. If there are no objections, the application is provisionally accepted for registration and the procedure moves on to the publication stage. In the event of refusal, the procedure is suspended at this stage. The applicant may appeal against the Office's decision within the prescribed time limit. The appeal is an additional legal procedure.
03
Publication of the trademark, opposition period If the examination of the application or the appeal is in favour of the applicant, the Office will announce its intention to grant protection in an official trademark newsletter (publication). During the publication period any person who considers that the registration infringes his previously acquired rights has the right to file an opposition. After considering te opponent's arguments, the Office makes a final decision on the trademark application. If the opposition is successful, the trade mark will not be registered.
04
Registration of the trademark, granting of the certificate of protectionIf no opposition is filed or the opponent's arguments are rejected, trademark is granted legal protection. The process ends with the issuance of the trade mark protection certificate by the office.

Client reviews of Trademark Partners services

The combined expertise in trademark protection and doing business in China determined the start of our business relationship with Trademark Partners. We are a very demanding client and expect the highest standards of ethics and professionalism in our work, confidentiality and efficiency in our cases. We particularly appreciate their guidelines for action, always taking into account local circumstances.

HEAD OF IPR, PHARMACEUTICAL INDUSTRY

Unknown to us, a Chinese company had registered a trademark identical to ours. After almost four years of proceedings, Trademark Partners succeeded in having the trademark registered in our favour. One of the reasons we were able to do this was because we worked very closely together to complete the evidence in the case. I can now confidently recommend Trademark Partners as a company that knows what it's doing when it comes to protecting trademarks.

CHRIS, THE OWNER OF COSMETICS BRAND

Trademark Partners helped me prepare my trademark application in China and brought the project to a successful conclusion. Today, my newly created trademark is protected in exactly the form I had envisioned.

ANDREA, DOCTOR, CO-OWNER OF A GERMAN EYEWEAR BRAND

Trademark Partners helped us retrieve a trademark that had been registered in bad faith by our Chinese distributor. They were able to first invalidate the unauthorised rights and then register the trademark for us. I would highly recommend this company.

CHRIS, THE OWNER OF POLISH FOOD COMPANY

As a medical practitioner by experience, I realise that the foundation of complete health is based on a holistic approach, encompassing medicine, psychology, diet, lifestyle and prevention. I needed to register a mark that illustrates this philosophy and in this respect I received professional and prompt support from Trademark Partners.
